Agreement to these terms

This website is operated by K3 Enterprises LLC (“K3,” “we,” “us”), an independently owned Michigan company with two divisions: Real Estate and Digital Development. By using the website, you agree to these Terms of Use and to our Privacy Policy, which explains how we handle information submitted through the site. If you do not agree, please do not use the website.

Using this website

You may use this website to learn about K3, view property listings, request showings, and get in touch with us. You agree not to:

• use the website for any unlawful purpose or in violation of any applicable law;
• submit false, misleading, or fraudulent information, or impersonate another person or organization;
• send spam, advertising, or unsolicited commercial messages through our forms;
• use bots, scrapers, or other automated means to submit forms, harvest information, or access the site in a way that burdens it;
• attempt to probe, bypass, or compromise the website's security, spam protection, or the services that support it;
• interfere with the website's operation or with any other person's use of it; or
• copy, reproduce, or republish the website or its content except as these terms allow.

We may limit, suspend, or block access to the website or its forms, without notice, if we reasonably believe these terms are being violated.

Forms and communications

When you submit a form, you confirm that the information you provide is accurate and that you are authorized to provide it. Submissions are delivered to us by email. Please do not send information that is more sensitive than the form asks for, such as a Social Security number or financial account details; our forms never request them.

Submitting a form sends us a message; it does not obligate K3 to respond in a particular way, to rent a property, or to take on a project. We read every submission and reply personally, but we cannot promise a response time.

Property information and housing inquiries

Property listings on this website are provided in good faith and maintained directly by K3. Availability, rental amounts, deposits, lease terms, utilities, features, and other listing details can change at any time without notice, and a listing may be withdrawn at any time. Confirm current details with K3 before relying on them. Some properties also appear on third-party listing sites; where anything differs, the information on this website is the version K3 maintains.

Submitting a contact message, housing inquiry, or showing request through this website:

• does not reserve or hold a property;
• is not a rental application, and does not start one;
• does not create a lease, a tenancy, or any other agreement; and
• does not guarantee that a showing will be available, that an application will be offered, or that an application will be approved.

Showings are confirmed by K3 by email or phone, and a requested time is not reserved until it is confirmed. Any rental decision is made through a separate application process, and any tenancy is governed by a written lease.

K3 is committed to equal housing opportunity and follows federal and Michigan fair housing laws. Nothing in these terms limits any right you have under those laws.

Digital Development services

Descriptions of Digital Development services on this website are general. They explain the kinds of work K3 takes on; they are not an offer to perform any particular work, and examples in the portfolio illustrate past projects rather than guaranteeing any particular result for yours.

A project inquiry is a request for a conversation. It does not create a client-services contract, and K3 is not obligated to accept any project. Project scope, deliverables, fees, payment terms, schedules, ownership of and rights to the work, confidentiality, and all other project-specific obligations are set out in the written agreement for that project, which is agreed before any work begins.

Separate agreements

These terms cover the use of this website only. A lease, rental application, Digital Development service agreement, or any other written agreement you sign with K3 governs its own subject matter. Where such an agreement is inconsistent with these website terms, the signed agreement controls as to its subject matter, to the extent permitted by law.

Intellectual property

The K3 Enterprises name, the K3 mark and logo, and the website's text, design, photographs, and code belong to K3 Enterprises LLC or are used with permission, and are protected by trademark and copyright law. You may view the website and print or save pages for your personal, non-commercial reference. Any other use, including copying the site's content, design, or branding for your own purposes, requires our written permission.

Client names, logos, brands, and websites shown in the Digital Development portfolio belong to the respective clients and are shown with their permission to illustrate K3's work. Property listing photographs are of K3's own properties. Any other third-party content remains the property of its owner, and nothing in these terms grants you rights in it.

Third-party websites and services

This website links to websites we do not control, including property listings on Zillow and the live websites of Digital Development clients. It also relies on third-party services to operate, such as hosting, email delivery, calendar scheduling, and spam prevention; the Privacy Policy identifies them. Those websites and services have their own terms and privacy policies. We are not responsible for their content, availability, or practices, and a link does not mean we endorse the linked site.

Availability and accuracy

We work to keep this website accurate, current, and available, but we cannot promise that it will be. The website and its content are provided “as is” and “as available,” for general information. We do not guarantee that the website will be uninterrupted, error-free, or free of harmful components, or that its content is complete or accurate at any given moment. To the extent permitted by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement, in connection with the website. Nothing on this website is legal, financial, or professional advice.

Limitation of liability

To the fullest extent permitted by applicable law, K3 Enterprises LLC and its owner will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or opportunities, arising out of or related to your use of, or inability to use, this website or its content, even if we were advised of the possibility of such damages. To the same extent, our total liability for any claim arising out of the use of this website will not exceed one hundred dollars ($100).

This limitation applies to the website only. It does not limit liability under a lease, service agreement, or other written agreement with K3, which is addressed in that agreement, and it does not limit or exclude any liability that cannot be limited or excluded under applicable law, including liability for fraud, for personal injury caused by negligence, or under fair housing or consumer protection laws. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Governing law

These terms and any dispute arising out of the use of this website are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules, and subject to any applicable law that provides otherwise. Any legal action relating to this website will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction, except where applicable law gives you the right to bring a claim elsewhere. Nothing in this section affects the law or venue that governs a separate written agreement with K3.

Changes to these terms

We may update these terms from time to time. The current version is always published on this page with its effective date, and changes take effect when they are posted. Your use of the website after a change means the updated terms apply to that use.

General provisions

• These terms and the Privacy Policy are the entire agreement between you and K3 regarding the use of this website.
• If any part of these terms is found unenforceable, the rest remains in effect.
• If we do not enforce a provision on one occasion, we may still enforce it later.
• You may not transfer your rights under these terms. We may assign them as part of a transfer of the business.
• Headings are for convenience and do not affect interpretation.
